How to Check for Georgia Criminal Records

Georgia supports the Freedom of Information Act by allowing public access to criminal records in the state. The Georgia Bureau of Investigation handles all criminal records for the state and you can contact them for a copy of someone’s complete history. They have a dedicated website for this express purpose and charge $15 per record. You can also get a copy of your own record using just a quick name search. There are also dozens of search portals online to use to find criminal records on someone in Ohio.

Federal Records vs. Court Criminal Records in Georgia

Georgia offers three ways to access court records both federal and local. You can use the Public Access to Court Electronic Records (PACER) system online. Additionally, you can use the state’s Multi-Court Voice Case Information System (MCVCIS) to get information over the phone, and you can visit the Clerk’s office of any courthouse to obtain copies of criminal court documents. You will have to pay a fee of per .10 per page or .50 if done over the phone. Older records are stored at the National Archives and Records Administration (NARA).

How Long do Felony or Misdemeanor Charges Last?

Unfortunately, your criminal record in Georgia stays active forever unless you petition the court to have it expunged. You can only do so if you were not formally charged within the statute of limitation, you complete a drug or alcohol treatment program, related to your offenses, you were found not guilty at trial, or you complete another rehabilitation program prescribed by the court. These are the only instances where you can apply to have your records expunged and get your records sealed.

Who Can Lookup your Criminal Background?

The general public has the right to search for and access your criminal history at any time. Using either the state’s own lookup resources or another online portal, anyone can get a copy of your criminal records pretty fast. You can also get a copy of your own records for purposes of licensing or personal reasons.

Why Check Someone’s Filed Criminal Charges?

There are various reasons why someone might want to look up your criminal charges online. Perhaps they are considering you to work on their home or you will spend time around their family. You might just be applying to purchase a gun. Your criminal history will come into play with any of these situations.

Types of Criminal Records

The types of criminal records that someone will be able to see when they access a copy of yours are arrests, convictions, sentencing, court disposition, the arresting agency, officer information, and attorney information. You will also see the name, address, phone, sex, weight, height, race, and date of birth. Sometimes mug shots and fingerprints will also be included.

How Are GA Criminal Records Created?

Georgia criminal records are created whenever someone enters the criminal justice system. When you get arrested, are charged with a crime, are held in jail overnight or let out on bail, records are created. These documents all become your criminal records.
