How to Calculate Child Support in New Jersey?
In New Jersey, obligation amounts are determined based on state guidelines. First, courts will determine the income of both parents, apply taxes and deduction and determine the parent’s combined net income. Each parent will be responsible for a percentage of support based on how much they contribute to the total family income. Courts will consider parenting time, add-ons and deductions before determining a final amount.
How to Claim and Pay Child Support?
Federal law requires most parents to automatically be under an income withholding order, so payments will be deducted from the non-custodial parent’s paycheck. Otherwise, parents can make payments online or through the mail. The funds are received by the New Jersey Family Support Payment Center and distributed to the custodial parent by direct deposit to either their bank account or a New Jersey Debit MasterCard.

Child Support and Taxes
Parents who no longer reside together must make a determination about who will claim the child on their state and federal tax returns. Only one parent can claim the child, so only one parent will get the tax credit. If the parents can’t come to an agreement amongst themselves, then courts are likely to give this benefit to the custodial parent.

Neither the receiving parent nor the paying parent should claim or report the support obligation on their tax returns. The paying parent won’t receive any sort of deduction, and the receiving parent can’t claim the money as income.

Paternity means legal fatherhood, and it describes the relationship a man has with their child. This legal determination is significant because children are increasingly being born outside of marriage. In these cases, the child will have no legal father unless steps are taken to establish paternity.

Unmarried parents can complete a Certificate of Parentage and file it with their local registrar’s office or county welfare agency to establish paternity. In cases where paternity is contested, courts may order genetic tests to be done. Paternity may be established through a court order.

Can a father get a paternity test without the mother?
A father who has no legal rights to the child must seek out the mother’s written consent for the child’s participation in a DNA test. On top of that, DNA tests that don’t include the mother’s sample won’t be as accurate.
How long does a father have to establish paternity in New Jersey?
New Jersey child support laws require parents to seek a paternity action within five years beyond the child’s 18th birthday.
Support order establishment
New Jersey strongly stands by the notion that every child has a right to financial support from both parents. Once paternity is established, the non-custodial parent will be required to make a basic payment to the other parent who is caring for the child. The courts will determine an appropriate amount by using state guidelines.
State Child Support orders
Courtrooms will then establish the support order, and the non-custodial parent must comply with the conditions. Parents have a right to request a modification or termination, but they should never voluntarily stop making payments. Such an action would be considered contempt of a court order, and it is enforceable through various measures.
Can the support be modified?
The amount a non-custodial parent owes may change over time due to cost of living arrangements or other changes. For this reason, cases are automatically eligible for review every two years.
How do I file for a modification of child support?
Parents should file a motion with the court that originally issued their child support order. The modification request must be based on a substantial change of circumstances.
Can a support order appealed?
Parents may file a motion to reevaluate the support order within 20 days of the order’s establishment. Appeals are only justified when a lower court has made an error or mistake.
Do you need a lawyer to modify the support and when can you do this?
A lawyer is not necessary when attempting to modify your obligation amount, but a lawyer can help protect your rights and sway the court in your favor at times.
Parents can make a change to the support order when there has been a substantial change of circumstances in either the paying parent’s income, the child’s needs or the custody arrangement

New laws passed last year extend the legal age for support to 23-years-old when the child is a full-time student in college, still in high school, disabled or when granted by the court. When these conditions don’t apply, support will end at 19-years-old.
