Delaware County
Delaware County, also known historically as the Delaware District, was created in 1907 and named for the Delaware Indians. The county covers a land area of approximately 738 square miles in southeastern Oklahoma, home to 40,791 residents. Its county seat is the City of Jay, while the largest city is Grove.
Delaware County has two trial courts, including the District and Municipal Courts. The District Court, which is Delaware County's general jurisdiction court, hears and decides all civil and criminal cases. Its Criminal Division typically presides over felony trials, misdemeanors, and criminal preliminary hearings. Meanwhile, the District Court's Civil Division handles class action cases, tort claims, contract breaches, personal injury lawsuits, and other financial disputes.
The District Court in Delaware County also has Family, Probate, and Juvenile Divisions. These court divisions oversee legal proceedings involving domestic relations cases, probates, and juvenile delinquencies in the county. Small claims cases such as landlord-tenant disputes, replevin, and other monetary claims under $10,000 are handled by the District Court. Delaware County's Municipal Courts handle traffic offenses and ordinance violations that occur in their cities.
