Morton County
Morton County was created in 1873 but didn't get formally organized until 1881. The county was named for Oliver Hazard Perry Morton and ranks as North Dakota's sixth-most populous county, with a population of nearly 33,900 residents (as of July 2023). Mandan serves as its county seat and also accounts for over 70 percent of the county's resident population.
The Morton County trial court system is part of North Dakota's South Central Judicial District and comprises District and Municipal Courts. The District Court has general jurisdiction in all legal matters filed in the county and exclusively handles all criminal and juvenile cases. Cases commonly filed in this court include felony offenses, misdemeanors, juvenile delinquency and dependency cases, divorce proceedings, child support, and similar family law matters, as well as probate and estate-related cases. On the other hand, the Municipal Courts are non-jury trial courts that have jurisdiction over criminal and non-criminal violations of local ordinances. These typically include Class B misdemeanors, infractions, and traffic violations; however, most cases involving juveniles are transferred to the District Court.
Morton County public court records comprise a variety of documented information generated during or received in relation to legal proceedings within the county. These records, which include court orders, sworn affidavits, case files, subpoenas, summonses, trial transcripts, judgments, verdicts, and settlement agreements, are under the custody of the county's Clerk of Courts. In addition to maintaining the county's court records, the Clerk of Courts is tasked with facilitating access to these records for interested members of the public.
