Comal County
Comal County was created in 1846 and located on the Edwards Plateau in Texas. Its total land area is 575 square miles. As of 2020, the population of the county was at 161,501. Comal County is known for its rich German-Texan and European histories. Its county seat, which is also its largest city, is New Braunfels.
The Constitutional County Court, District Courts, County Courts at Law, Justice Courts, and Municipal Courts are courts of trial addressing legal issues in Comal County. The County Courts at Law preside over all Class A and B misdemeanor criminal cases and civil cases filed in the County Courts. These courts also have jurisdiction in probate and guardianship matters. The Comal County Courts at Law also hear traffic cases and appeals from Justice and Municipal Courts. In addition, they have concurrent jurisdiction with District Courts over family law cases, such as divorce and adoptions.
Justice Courts in Comal County have jurisdiction over civil, small claims, administrative hearings, and eviction suits up to $20,000 exclusive of interest. These are usually lawsuits over debts, evictions, car accidents, unlawful towing, and properties.
District courts are the general trial courts handling most litigation cases in the county. They have original jurisdiction over felony criminal cases, divorce cases, matters involving title to land, election contests, and civil matters in which the amount of money or damages involved in dispute is $200 or more. Each county must be served by at least one District Court. However, less populated areas may be served by a District Court, while urban counties may be served by multiple District Courts.
The Constitutional County Court has general jurisdiction over probate, juvenile, guardianship, and mental health matters. Constitutional County Courts have concurrent jurisdiction with justice courts on civil cases in which the amount of money involved in a dispute is at least $200 but not more than $20,000 exclusive of interest. Constitutional County courts have concurrent jurisdiction with District courts on civil cases in which the amount of money in controversy is $500 or more but does not exceed $5,000 exclusive of interest.
Bulverde, Garden Ridge, and New Braunfels Municipal Courts have exclusive jurisdiction over violations of city ordinances, and also share jurisdiction with Justice Courts over misdemeanors. They also share jurisdiction with County Courts and District Courts over the enforcement of health standards and nuisance abatement ordinances.
