Montgomery County

Located 30 minutes northwest of the City of Nashville, Montgomery County covers 539.2 square miles of land area and has a population of over 220,000 residents. Montgomery County is Tennessee's 28th largest county by total area. It was established in April 1796 and named for John Montgomery, an American settler and soldier credited with founding Clarksville, Tennessee.

The court structure in Montgomery County comprises a municipal court, juvenile court, general sessions court, chancery court, and a circuit court. The municipal court generally handles municipal ordinance violations and may also hear a juvenile traffic violation case if jurisdiction is waived by a juvenile judge.

Exclusive jurisdiction over most juvenile delinquency and dependency cases belongs to the juvenile court. Some of the criminal cases handled by the juvenile court include violations of parental responsibilities by parents or guardians. However, some juvenile delinquency matters involving some crimes may be transferred to other courts in order to prosecute the juvenile as an adult.

The general sessions court has limited jurisdiction over civil and criminal matters. Its civil jurisdiction is restricted to specific monetary limits and action types. The criminal jurisdiction of the court is limited to preliminary hearings in felony matters and misdemeanor trials where a defendant waives the right to grand jury investigation and trial by jury in a criminal or circuit court.

The chancery court in Montgomery County hears civil cases such as contract or debt, real estate, probate, conservatorship, guardianship, workers' compensation, adoption, divorce, and partition suits. Montgomery County circuit courts are courts of general jurisdiction. The judges in the court hear civil cases, criminal cases, and appeals of decisions from the juvenile, general sessions, and municipal courts. Often, the jurisdiction of Montgomery circuit court overlaps that of the chancery court.
