Spartanburg County
Formed in 1785, Spartanburg County is South Carolina's fifth-most populous county and home to nearly 356,700 people. The county was named after the Spartan Regiment, a local militia unit that fought in the American Revolutionary War, and covers a total area of approximately 820 square miles.
The Spartanburg County trial court system comprises Circuit, Family, Probate, Magistrate, and Municipal Courts:
- The Circuit Court consists of a Court of General Sessions for criminal matters and a Court of Common Pleas for civil matters. This is the county's general jurisdiction trial court, and it typically handles matters outside the jurisdiction of the other courts, such as felonies and civil matters involving more than $7,500.
- The Family Court has exclusive jurisdiction over family law, domestic relations, and juvenile matters. However, serious charges involving juveniles may be transferred to the Circuit Court.Â
- The Probate Court is a limited-jurisdiction court that handles marriage licenses, conservatorships, guardianships of incompetents, involuntary commitments, trusts, minor settlements under $25,000, and other probate-related matters.Â
- The Magistrate Court handles criminal cases that a punishable by a maximum fine of $500, jail time of not more than 30 days, or a combination of both, and civil cases that do not involve more than $7,500. This court also conducts preliminary hearings, sets bail, and issues arrest and search warrants.
- The Municipal Courts typically handle the same kinds of cases as the Magistrate Court. They also have jurisdiction over ordinance violations within their respective municipalities and can hear criminal cases transferred from the Circuit Court (this only applies to cases with a maximum penalty of $5,000 in fines, imprisonment of up to one year, or both).
