Clackamas County
Clackamas County is the third most populous county in Oregon with a population of 421,401 inhabitants. It was originally named Clackamas District, being one of the four original Districts created on July 5, 1843 by Oregon's Provisional Legislature. Clackamas County spans 1,883 square miles. Its county seat is in Oregon City while Lake Oswego is its largest city.
Circuit Courts, Municipal Courts, and a Justice Court make up the trial court system in Clackamas County. Circuit Courts in Clackamas County are courts of general jurisdiction and the highest trial courts. They settle issues on land dispute, juvenile, adoption, child custody, and probate matters. They also handle felony and murder cases as well as hold preliminary hearings and hear cases beyond the jurisdiction of other courts in the county.
Municipal Courts share certain jurisdiction with the Justice Court and Circuit Courts over misdemeanors and ordinance violations. They typically handle cases about traffic violation, vehicle impoundment, and drug violation as well as municipal ordinance violations.
The Justice Court is divided into “of record†and “of no recordâ€. The Justice Court “of record†handles misdemeanors, while the Justice Court “of no record†transfers misdemeanor cases to Circuit Courts after holding preliminary hearings. They handle criminal prosecutions except felonies, landlord-tenant cases, and small claim cases in which the amount of money in dispute is $5,000 or less
