Schoharie County

Schoharie County is in the Mohawk Valley region of New York and is part of the Albany-Schenectady-Troy Metropolitan Statistical Area. It is the fifth-least populous county, with a total population of 30,105 inhabitants. The county was created by joining portions of Albany and Otsego counties in 1795.

In the Schoharie County court system, legal matters are handled by several courts, such as:

  • Supreme Court: It is a general jurisdiction court that can hear almost all cases, except those in which another court has exclusive jurisdiction. However, it focuses majorly on civil and matrimonial cases
  • County Court: It handles all felony charges and misdemeanor cases transferred from the town and village courts. This court also presides over probate and estate matters, family law cases, and civil cases involving monetary claims under $25,000
  • Town and Village Courts: These courts are designed to manage several legal matters at the local level, such as misdemeanors, traffic violations, small claims, landlord-tenant disputes, and domestic violence cases
  • Surrogate's Court: It is concerned with overseeing deceased persons' estates, adoption proceedings, and trust administration
  • Family Court: It addresses legal matters related to domestic and family issues, including child abuse and neglect, child custody and visitation, paternity, juvenile delinquency, and domestic violence cases

Schoharie County court records are generally accessible to the public unless restricted by state law or court order to protect the private information of involved parties. These records are maintained by the County Clerk, who serves as the Clerk of Court for both County and Supreme Courts. The best method to access court records is to submit a request with accurate descriptions to the County Clerk's Office.

Instead of paying the County Clerk to locate your desired records, you may visit the Clerk's Office during regular business hours to search and make copies of publicly available court records.

Through the eCourts website, Schoharie County residents have remote access to information on family, civil, and criminal cases heard in the county courts.
