Burleigh County
Burleigh County is located in south central North Dakota and was named for a physician, trader, Indian agent, and delegate to the 39th and 40th Congress - Dr. Walter Burleigh. Organized in 1873, Burleigh County covers 1,632.7 square miles of land area and is home to over 98,000 residents per the 2020 decennial census.
The trial court system in Burleigh County comprises the municipal courts and the district court. Municipal courts preside over cases involving city ordinances, except certain involving juveniles. However, municipal courts are not authorized to handle cases involving the violation of state laws.
District courts are the trial courts of general jurisdiction over civil and criminal cases. Per North Dakota law, Burleigh County district court have:
- Common-law jurisdiction over the redress of all wrongs committed against North Dakota laws affecting property or persons
- The authority to decide all civil actions and proceedings
- Jurisdiction of appeals from final judgments of municipal courts and from the determinations of inferior officers, tribunals, or boards in the cases and per the regulations as may be prescribed by law
- The right to hear and determine all actions and proceedings resulting from the enforcement of county home rule charter ordinances
The clerk of the district court in Burleigh County maintains the records for civil and criminal cases heard at the district courts in the county. Members of the public can access these records by making a request in person at the courthouse. A public terminal for access within the courthouse may also be used to access public court records.
