Henry County
Established in 1822 in the East Central region of the state, Henry county was partitioned from Delaware New Purchase. Its county seat, New Castle, is the only city in the county. Henry County has a population of 48,915.
The New Castle City Court and Circuit Courts make up the trial court system ruling on cases arising from Henry County. There are three divisions of the Circuit Court in Henry County, all located in New Castle. The Circuit Courts are courts of unlimited jurisdiction and handle cases beyond the jurisdiction of city and town courts. They handle felonies, misdemeanors, ordinance violations, small claims, civil equities, and domestic relations charges.
The City and Town Court/ New Castle City Court handles city code/ordinance violations and traffic cases. A traffic offender must appear in court if they refuse to fulfill the conditions on their citation.
The Henry County Circuit Court Clerk is the keyholder to circuit court records. The office maintains the dockets and details gathered from court judgments, trials, orders, warrants, and petitions. The Circuit Clerk files them appropriately for use by the public, attorneys, and law enforcement agencies.
You may search Henry County court records on the Indiana Judicial Branch website. It allows you to search non-confidential cases in courts utilizing the Odyssey case management system. Generally, you may request court records and documents from the office of the clerk where a case was heard, especially for records that are not available online. You may request a transcript of a hearing or trial from the court reporter.
Per the Indiana Rules on Access to Court Records, court records are public documents and the court does not need litigants' consent to make court records available online except in cases where the use or dissemination of court records are to preserve confidentiality. However, the Indiana General Assembly has statutory procedures that may allow certain people in specific situations to ask a court to remove their court records from public access. Such restricted records include juvenile, felony, infraction, and misdemeanor.
The Clerks' Offices in the Circuit Court and Newcastle City Court are judicially responsible for providing these kinds of non-confidential court records to the public.
