Macoupin County, formed in 1829 from Greene and Madison counties, is the 11th largest county by area in Illinois. With the county seat located in Carlinville City, Macoupin County is home to about 44,967 people, spread across 863 square miles of land.
Macoupin County operates a unified judicial system built around the Circuit Court. The 7th Judicial Circuit Court in the county has jurisdiction over all cases, including civil, criminal, traffic, family law, juvenile, and probate cases. It shares jurisdiction with the Supreme Court over cases related to tax revenue, mandamus, and prohibition as well as habeas corpus matters. However, the Circuit Court may lose this shared jurisdiction if the Supreme Court exercises its authority over any of the cases.
The Macoupin County Circuit Court is divided into three specialized Divisions, namely the General Division, Traffic and Criminal Division, and Probate Division. All divorce lawsuits, tax revenue cases, and chancery cases like foreclosures in the county are decided by the General Division. The Traffic and Criminal Division oversees cases regarding conservation and traffic violations, as well as criminal cases like felonies and misdemeanors. Family relations, juvenile, small civil claims, and probate cases are handled by the Probate Division.
