Elmore County
Named after the Ida Elmore mines producing silver and gold in that area in 1860, Elmore County was formed on February 7, 1889. Rocky bar was formerly its county seat until the county seat moved to Mountain Home on February 4, 1891. Elmore County spans 3,101 square miles with a population of 28,666 according to the 2020 census. It belongs to the 2nd Congressional District.
The District Court is the primary trial court in Elmore County and has a Magistrate Division within it. The District Court has exclusive jurisdiction over hearings for felony cases and criminal case appeals.. It also handles general civil cases in which the amount of money involved in dispute is $10,000 or more, some domestic relation matters as well as juvenile and probate cases. It generally handles cases beyond the jurisdiction of the Magistrate Division.
The Magistrate Division functions within the District Court and hears matters relating to preliminary hearings for all criminal cases, misdemeanors, infractions, felonies, general civil matters involving $10,000 or less, guardianships of minors and adults, driver's license suspension, name changes, and civil commitment. Furthermore, the Magistrate Division has a small claims department handling cases in which the amount of money involved in dispute is $5,000 or less.
The District Court has a court-supervised treatment program such as Adult Drug and DUI Court, and in addition, juvenile and adult misdemeanor probation programs.
