Maui County
Maui County is located in the State of Hawaii. It consists of Lana'i, some sections of Moloka'i, and Maui, all islands. The county was founded in 1905 and its 1,161.5 square miles of land area is populated by more than 160,000 residents.
The trial court system in Maui County comprises a family court, four district courts, and one circuit court.
The family court is typically considered divisions of the district and circuit courts. It has a juvenile unit and a domestic violent unit. The family court handles cases relating to divorce, paternity, child support, guardianship of adults and children, and cases of domestic violence. The court has exclusive jurisdiction over juvenile matters, child neglect, juvenile delinquency, judicial consent to marriage, and juvenile curfew violation. The family court has jurisdiction in some criminal cases, such as in offenses committed against a child by the child's legal custodian or parent, and abandonment, desertion, and violations of domestic abuse protective orders.
The district court handles misdemeanor and petty misdemeanor cases, and violation and traffic violation cases involving trials. These cases include violations of the Department of Land and Natural Resources regulations and citations issued by the Maui Humane Society. The district court also handles liquor law violation cases.
The circuit court has general jurisdiction over all criminal and civil cases, including jury trials. These involve felony jury trials but may also include trials before a judge or jury trials for misdemeanor offenses. The court presides over pretrial proceedings, such as motions, and post-trial proceedings, including sentencing and matters before the Hawai`i Paroling Authority.
