Henry County
The Georgia State Legislature created Henry County in 1821 from the land acquired from the Creek Indian Nation. Presently, the county has a population of 254,613 people. Henry County covers a total area of 327 square miles and its seat of government is the City of McDonough.
The Henry Court system consists of a general jurisdiction court (superior) and four limited jurisdiction courts (state, probate, juvenile, and magistrate). The Henry County Superior Court has statutory authority over felony, misdemeanor, domestic relations, title to land, and equity cases.
The Henry County State Court adjudicates misdemeanor criminal cases relating to battery, criminal trespass, DUI, and the violations of traffic and city/county ordinances. It also handles general civil cases such as breach of contract, wrongful death, medical malpractice, and product liability. The Magistrate Court in Henry County holds hearings for civil cases and certain minor offenses including deposit account fraud, foreclosure, garnishment, county ordinance violations, dispossessories, and civil claims of $15,000 or less.
The wellbeing and security of children removed from their homes are the responsibility of the Juvenile Court. This court also hears juvenile delinquency cases, but it shares jurisdiction with the superior court over capital felonies, child support, and child custody. The Henry County Probate Court has original jurisdiction over wills, guardianships for incapacitated persons and minors, and estate administration.

For example, the Superior Court Clerk maintains the records of cases filed in the superior court and grants access to criminal and civil records.
