Gwinnett County
Gwinnett County was formed as part of Jackson County on December 15, 1818. It was created by an act passed by the Georgia General Assembly and named after Button Gwinnett, one of the signatories of the Declaration of Independence. Gwinnett County stretches across 437 square miles and it is the most ethnically diverse county in Georgia. It has a population of 942,627 residents, its county seat is in Lawrenceville, and its largest city is Peachtree Corners.
The trial court system in Gwinnett County, consists of several courts including the Superior Court, Juvenile Court, Probate Court, State Court, Magistrate Court, Recorder's Court, and Municipal Courts.
The Recorder's Court in Gwinnett County handles traffic and city ordinance violations. It acts upon traffic citations issued from the County's Police and Sheriff Departments, Georgia Department of Driver Services, and the Georgia Department of Transportation. The Probate Court handles the administration of estates for decedents, guardianship and conservatorship for adults and minors. Futhermore, it issues death, marriage, birth, and weapon carry licenses, and fireworks permits.
The Juvenile Court has jurisdiction over juvenile delinquency cases and has a volunteer programs unit that advocates for minors and rehabilitates minors for offenses committed. The Superior Court is in charge of reviewing the trial cases handled by lower courts. It is a court of general jurisdiction and tries felony cases. It has a drug treatment court to help persons charged with DUIs and felony drug charges.
The State Court handles misdemeanor and traffic offenses. The Magistrate Court is a non-jury trial court that hears civil and criminal cases. It issues search warrants, holds preliminary hearings, and handles civil cases in which the amount of money involved in dispute is $15,000 or less. Municipal Courts have jurisdiction over traffic offenses, violations of State law, animal control violation, misdemeanor cases involving shoplifting, marijuana possession. In addition, they issue warrants and try cases on violation of city ordinances.
The Gwinnett County Clerk of Superior, State, Juvenile, and Magistrate Courts creates, files, and distributes records of court proceedings in the county. The Office of the Clerk of Courts /Clerk of Superior, State, Juvenile, and Magistrate Courts performs other responsibilities such as Deed and Property Recording, Court Registry Management, and Court Technology Management.
