Baldwin County

Baldwin County, Georgia, was created out of the land lottery of 1803 and occupies an area of 258 square miles. It is sparsely populated, housing approximately 43,396 as of 2023. The county has a relatively diverse population, with White and Black/African American ethnic groups constituting the majority of its residents.

The Baldwin Superior Court is the general jurisdiction court with the exclusive constitutional authority to handle felony cases, divorce cases, title-to-land disputes, equity matters, quo warranto, and habeas corpus cases. In addition, this court can review decisions made by lower courts in the county.

The State Court exercises jurisdiction over misdemeanor violations and all civil lawsuits, regardless of the amount claimed, except for cases in which the Superior Court has exclusive jurisdiction. It may also punish contempt by imposing a jail sentence and/or fine and reviewing decisions from lower courts.

The Baldwin Magistrate Court addresses civil claims for amounts up to $15,000, county ordinance violations, bad check warrants, and evictions. It also issues arrest warrants for both domestic and non-domestic cases. Meanwhile, legal matters involving minors, including juvenile dependency and minor violations of the law, are determined in Juvenile Court.

The Probate Court serves the county residents by administering the estate of deceased persons, appointing guardians or conservators to oversee the affairs of minors or incapacitated persons, and supervising elections. The Milledgeville Municipal Court has jurisdiction over all traffic cases, certain misdemeanor state cases, and the violation of city ordinances.

The Clerk of Superior Court serves as the official record keeper for court records generated from cases initiated in the Juvenile, State, and Superior Courts. Members of the public have the right to review or request copies of these records by visiting the Clerk's Office or submitting a written request. However, this right is not absolute, as certain records, such as those related to juvenile proceedings, may be deemed confidential.
