Macomb County
Macomb County is a county in southeastern Michigan. It was named for a decorated veteran of the War of 1812 - General Alexander Macomb and formally organized in January 1818. Macomb County covers 479.3 square miles of land area and has a population of 881,217 in 2020.
There are three major court types in Macomb County. These courts (probate, district, and circuit courts) make up the trial court set up in the county.
The probate court has exclusive legal and equitable jurisdiction in conservatorships, decedent's estates, guardianships, protective proceedings, and commitment proceedings.
The district courts in Macomb County are limited jurisdiction courts with jurisdiction over criminal misdemeanors, civil cases where the amount in controversy is up to $25,000, traffic violations, parking violations, landlord-tenant disputes, and small claims cases of up to $7,000. The district court also has initial jurisdiction on criminal felony cases in determining probable cause.
The circuit court handles cases beyond the jurisdiction of other courts in the county, including felonies and lesser-included offenses. It has jurisdiction over civil cases involving amounts in excess of $25,000, equitable relief, domestic relations cases, and some serious misdemeanors. The court also has specialty courts such as adult drug court, DWI/sobriety court, mental health court, and veterans' treatment court.
The Macomb County clerk functions as the clerk of the Macomb County circuit courts and maintains court records for civil, domestic, and criminal cases filed with the court.
