Montgomery County
Montgomery County is located in Maryland. It was created from Frederick County and established in September 1776. It is the most populous county in Maryland and was named for Richard Montgomery, a Revolutionary War General who died in 1775. Montgomery County is home to over 1 million residents.
Orphans' court, district courts, and circuit courts make up the court system in Montgomery County. The Montgomery County orphans' court has limited jurisdiction over some probate and guardianship cases. Some tax issues relating to probate matters and some issues pertaining to the ownership of land related to probate cases and guardianships are heard in the orphan's court. Only one orphans' court is in Montgomery County.
The district courts in Montgomery County handles replevin actions, landlord-tenant cases, criminal cases classified as misdemeanors, traffic violations, some felonies, and civil cases where the amount in question does not exceed $30,000. No jury trials are held in the district courts. The district court has exclusive jurisdiction in claims where the amount in controversy is up to $5,000. They have concurrent jurisdiction with the circuit court in claims where the amount in question is more than $5,000 but less than $30,000. The district court's jurisdiction is concurrent with that of the circuit court in cases classified as misdemeanors and some felonies, where the penalty is a 3-year imprisonment or more, or a fine of $2,500 or more. Two district courts (in Rockville and Silver Spring) exist in Montgomery County.
The circuit courts are where jury trials are held in the county. They handle more serious criminal matters and major civil cases, such as family law and juvenile cases, including custody, divorce, domestic violence, and child support. Appeals of some administrative agencies, district courts, and the orphans' court are heard in the circuit court.
